Recipient Terms of Access and Acceptable Use Policy

By selecting an acceptance box, submitting an email address, opening a delivery email or accessing a Resource, you agree to these Recipient Terms and the Privacy Policy.

If you are under 18, you may use Gluuer only with the permission and supervision of a parent or legal guardian who accepts these Recipient Terms for you.

If you create an account and publish your own lead magnets, the Account Holder Terms apply to that use.

• Account Holder: the person or organization using Gluuer to provide a Resource and collect Recipient details. The Account Holder may also be identified by a creator name, sender name or business name.
• Gluuer, we, us or our: Gluuer, a trading name operating under ABN 51 152 756 523.
• Lead Magnet: a Gluuer link through which you may request a file or access link in exchange for an email address.
• Recipient or you: the person visiting a Resource Page, submitting an email address or accessing a Resource.
• Resource: the file, external destination, title, description, offer and related material supplied by an Account Holder.
• Resource Page: the Gluuer-hosted page through which a Recipient requests a Resource.
• Service: the Gluuer pages, delivery emails and related functions used to request and access a Resource.

Gluuer provides technology that allows an Account Holder to collect an email address and deliver a file or external link. The Account Holder, not Gluuer, supplies and controls the Resource, description, offer, destination and intended use of your information.

Gluuer does not create, verify, recommend, sponsor or endorse the Account Holder or the Resource. The presence of a Gluuer page, email, badge, QR code or link does not mean that Gluuer has reviewed or approved the content.

Any purchase, promise, service, advice, statement or relationship connected with a Resource is between you and the Account Holder or relevant third party.

• You must submit an email address that belongs to you or that you are authorized to use.
• Submitting an email address requests delivery of the specific Resource identified on the Resource Page.
• A separate optional checkbox may allow you to receive additional content or marketing from the Account Holder. You may request the Resource without selecting that optional box.
• The Account Holder is responsible for any later marketing and for honoring unsubscribe requests relating to its own communications.
• Gluuer does not use your email address for Gluuer marketing unless you separately choose to receive communications from Gluuer.
• If you receive marketing you did not request, contact the Account Holder shown on the Resource Page or communication. You may also contact Gluuer about information still held within the Service.

Only request or access a Resource from an Account Holder you recognize and trust. You are responsible for deciding whether the source, file, external destination and requested action are appropriate for you.

• Use current device, browser and security protections before opening a file or external link.
• Check the apparent sender, Resource title, file type and destination before opening or downloading anything.
• Do not enter passwords, payment information, identity documents or other sensitive information into an external destination unless you have independently confirmed that it is legitimate.
• Do not assume that a Gluuer-hosted page or delivery email means that the Resource is safe, accurate, lawful or endorsed by Gluuer.
• Stop and report the Resource if it appears suspicious, misleading, unlawful or harmful.

Your right to use a Resource is granted by the Account Holder or relevant rights owner, not by Gluuer. Any license, confidentiality notice, copyright restriction or restriction on redistribution supplied by the Account Holder applies between you and that Account Holder.

You must not copy, publish, sell, redistribute, modify or exploit a Resource in a way that infringes another person's rights or breaches a restriction that lawfully applies to you.

Gluuer does not provide digital rights management and is not responsible for enforcing restrictions after a Resource has been delivered or accessed.

You must not misuse a Resource Page, delivery email, Resource or Gluuer system. In particular, you must not:

• submit another person's email address without authority;
• use bots, scripts, automated form submissions, scraping or high-volume requests;
• attempt to bypass the Resource Page, email gate, access controls, rate limits or security measures;
• probe, test, reverse engineer, interfere with or attempt unauthorized access to Gluuer or another user's information;
• use Resource Pages or delivery emails for harassment, email bombing, list poisoning or disruption;
• submit knowingly false, abusive or misleading reports;
• redistribute a Resource unlawfully or use it to infringe copyright, confidentiality, privacy or other rights;
• use a Resource or external destination for fraud, phishing, malware distribution, illegal commerce, abuse, harassment or other unlawful conduct;
• misrepresent your identity, authority, relationship with an Account Holder or reason for requesting a Resource.

You can report suspected scams, malware, unlawful content, impersonation, copyright infringement, privacy concerns or other misuse through gluuer.com/contact. Include the Gluuer link and enough information to identify the concern.

Gluuer relies primarily on user reports and does not undertake to pre-screen every Resource. Gluuer may review reports and may temporarily or permanently restrict a Resource or Account without notice where necessary to reduce harm, protect the Service or comply with law.

Gluuer is not required to determine private rights or resolve disputes between you, an Account Holder and another party. Claims about the content, quality, accuracy, entitlement, promised benefit or use of a Resource should ordinarily be directed to the Account Holder.

A Link Resource may send you to a website, platform, store, video, document or other destination controlled by the Account Holder or a third party. Gluuer does not control and is not responsible for the destination, including its content, availability, security, prices, access rules, cookies or privacy practices.

Review the destination's terms and privacy information before providing information or taking action.

Delivery emails may be delayed, blocked or directed to spam, promotions or another folder because of mailbox settings, invalid addresses, provider rules, filtering or network conditions. Gluuer does not guarantee a particular delivery time or inbox placement.

A Resource may be paused, removed, expired or unavailable because of the Account Holder's plan, a report, legal requirements, technical limits or another operational reason. Gluuer does not guarantee permanent access.

Gluuer owns or licenses the Service, branding, interface, software and related materials. You may use the Service only to request and access Resources in accordance with these Recipient Terms.

The Account Holder or another rights owner retains rights in the Resource. Access does not transfer ownership to you.

To the maximum extent permitted by law, the Service and all user-provided Resources are made available on an as-is and as-available basis.

• Gluuer does not guarantee that a Resource is safe, free from malicious code, lawful, accurate, complete, useful or suitable.
• Gluuer does not guarantee the identity, authority, qualifications or trustworthiness of an Account Holder.
• Gluuer does not guarantee the availability, security or conduct of an external destination.
• You access and use a Resource at your own discretion and risk, subject to rights that cannot lawfully be excluded.

Nothing in these Recipient Terms excludes statutory rights or remedies that cannot lawfully be excluded.

To the maximum extent permitted by law, Gluuer is not liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of data, opportunity, profits, goodwill, reputation, business or expected benefit arising from a Resource, Account Holder, external destination or use of the Service.

To the maximum extent permitted by law, Gluuer's total aggregate liability to you arising out of or relating to the Service or these Recipient Terms is limited to USD 100.

The limitations in this section do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct or a non-excludable statutory obligation.

To the extent permitted by law, you are responsible for claims, losses, liabilities, costs and reasonable legal expenses to the extent caused by your breach of these Recipient Terms, unlawful redistribution of a Resource, unauthorized use of another person's email address, misuse of the Service or infringement of another person's rights.

You are not responsible under this section to the extent a loss was caused by Gluuer's breach, negligence, fraud or willful misconduct.

Gluuer handles personal information as described in the Privacy Policy. The Account Holder may separately control and use your information for its own purposes. Contact the Account Holder about its marketing, exported contact records and communications. Contact Gluuer about information that remains in Gluuer's systems or about Gluuer's own practices.

Before starting formal proceedings against Gluuer, you agree to send details of the dispute through gluuer.com/contact and allow 30 days for an informal resolution, except where urgent relief is required or the law gives you a right that cannot be restricted.

These Recipient Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have jurisdiction, subject to mandatory rights under the laws of your country or place of residence that cannot lawfully be excluded.

Gluuer may update these Recipient Terms. The version available when you use the Service applies to that use. Material updates will be published through the Service or communicated by another reasonable method where required.
